rental Agreement Terms and conditions

1. IDENTITY OF PARTIES:

For the purposes of these Terms and Conditions, the term “Company” refers to Jump for Joy LLC, including its owners, officers, employees, contractors, and agents. The term “Customer” refers to any person or organization using the Company’s services or equipment. The term “Equipment” refers to any items supplied by the Company for use.

2. GENERAL RELEASE / INDEMNITY / HOLD HARMLESS:

Customers are responsible for the safe operation, installation, and use of all Equipment. Customers agree to take necessary precautions to protect persons and property from injury or damage. The Company is not responsible for injuries, damages, or claims arising from the use, possession, or operation of Equipment. Customers agree to defend, indemnify, and hold the Company harmless from any and all claims, liabilities, damages, costs, or attorney fees related to the use of Equipment, including but not limited to injuries or property damage.

3. PAYMENTS & RENTAL TERMS:

All fees must be paid in full prior to delivery of Equipment unless otherwise arranged. The rental period begins upon delivery and ends when the Equipment is picked up by the Company. No refunds are provided due to weather or other conditions once the Equipment has been delivered and accepted.

Cancellations made within 72 hours of the scheduled rental will result in forfeiture of the deposit, except in cases of severe weather or verified emergency situations, in which case the deposit may be applied to a future rental at the Company’s discretion.

4.  DELIVERY & PICK-UP:

The Company will deliver and pick up Equipment at the agreed-upon location, stated during the booking process. Customers grant the Company access to the property for set-up and removal. Equipment may not be moved to a different location without the Company’s consent. Customers are responsible for Equipment until it is picked up. Additional fees may apply if Equipment is not available for collection at the scheduled time.

5. SAFETY AND OPERATING INSTRUCTIONS.

Customers must read and follow all safety and operating instructions provided with the Equipment. Adult supervision is required at all times when Equipment is in use. Equipment must not be operated in unsafe conditions (e.g., near water, in high winds, or while in disrepair).

6.  RECEIPT AND INSPECTION OF RENTAL EQUIPMENT:

Customers are responsible for inspecting Equipment prior to use and ensuring it is suitable for their needs. Use of Equipment signifies acceptance of its condition.

7.  POSSESSION AND TITLE

Equipment remains the property of the Company at all times. Customers may not sell, sublease, or transfer Equipment. If Equipment is lost, stolen, or not returned, the Customer is responsible for full replacement costs.

8.  CARE AND USE: 

Customers must use Equipment only for its intended purpose and in compliance with all laws and regulations. Equipment must be protected from theft, weather, and misuse. Altering or attempting to repair Equipment without the Company’s permission is prohibited.

9. DAMAGE AND LIABILITY:

Customers are liable for any damage beyond normal wear and tear, including stains, tears, misuse, or exposure to prohibited substances. Damaged or missing items may incur repair or replacement charges.

10.  CLEANING FEES:

Equipment must be returned clean and dry. If returned in poor or dirty condition, cleaning fees may apply.

11.  EQUIPMENT MALFUNCTIONS:

If Equipment does not function properly, Customers must immediately discontinue use and contact the Company.

12. INFLATABLE UNIT(S):

Certain Equipment, such as inflatables, concession machines, tents, or specialty items, include additional safety and operating rules. These rules are provided directly with the Equipment and must be read and followed at all times. Failure to comply with these rules may result in damage fees, loss of deposit, or liability for injuries or damages.

13. SITE REQUIREMENTS:

Installation sites must be clean, level, and free from hazards. Adequate clearance and access to power sources are required.

14. OVERNIGHT USE:

Unless otherwise approved, inflatables and similar Equipment may not be operated overnight. Equipment must be stored securely when not in use.

15.  LIMITED WARRANTY:

The Company warrants that Equipment will be in good working order upon delivery. No other warranties, express or implied, are provided. Customers assume all risks of use.

16.  GOVERNING LAW:

These Terms are governed by the laws of the State of Nebraska. Any disputes shall be resolved in the appropriate courts of Lincoln County, Nebraska.

17. LEGAL FEES:

In the event of legal action, the prevailing party is entitled to recover reasonable attorney’s fees and costs.

18. SEVERABILITY:

If any part of these Terms is found unenforceable, the remaining provisions will remain in full effect.

19. ENTIRE AGREEMENT:

These Terms constitute the entire agreement between the Customer and the Company and supersede all prior discussions or agreements.
